The Department of Justice (DOJ) has rejected former President Rodrigo Duterte's accusations that former Interior Secretary Benhur Abalos and top police officers were responsible for the search for now-detained televangelist Apollo Quiboloy in Davao City last year.
In a resolution released Thursday, prosecutors found no probable cause to pursue charges of malicious mischief and trespass, citing insufficient evidence and the presumption that officials acted within the bounds of their duties.
"Their actions, as alleged, fall within the realm of lawful performance of duty and are protected by the presumption of regularity in official functions," the resolution read. "Absent any overt act that constitutes an element of the crimes charged, and in the absence of malice, unlawful intent, or personal participation, this Office finds no basis to indict the respondents."
The DOJ added there was no indication that the police acted unlawfully or entered any property in clear violation of the law.
